Privacy Policy

This Privacy Policy explains how Holistic Pathways Legal Advisors ("Holistic Pathways," "we," "us") collects, uses and shares information through holisticpathwaylegal.com (the "Site"). It applies to the Site and to inquiries you send us. Engagements with attorneys and law firms are also governed by a written engagement agreement and, where required, a HIPAA Business Associate Agreement.

Please do not send medical records, patient names, dates of birth or other protected health information (PHI) through this Site, its contact form or ordinary email. After an engagement is confirmed, records are exchanged only through an encrypted channel set up for that matter. See our HIPAA & Health Information Statement.

1. Information we collect

Information you give us

• Contact form: your name or firm name, email address, case type, a brief summary of the matter, and whether you consented to be contacted.
• Correspondence: anything you choose to include when you email, call or message us.

Information collected automatically

• Server logs: our web host records standard technical data when any page loads (IP address, browser and device type, pages requested, referring page and time of request), for security and to keep the Site running.
• Content delivery: when a page loads, your browser requests fonts from Google Fonts and a graphics library from cdnjs (Cloudflare). Those providers receive your IP address and browser information as part of delivering the files.

Cookies and your choices

When you first visit, a banner asks you to choose Accept all or Essential only. Both choices carry equal weight, and you can change yours at any time with the Cookie settings link in the footer.

• Essential storage (always on): the Site saves your cookie choice in your browser's local storage so it doesn't ask again. This is needed for the Site to work and contains no personal information.
• Optional analytics (only if you accept): we do not currently use any analytics, advertising or tracking cookies. If we add privacy-respecting analytics later, they will load only for visitors who choose "Accept all," and we will list them here first.

We never use advertising pixels or session-recording tools, and we do not look up your location from your IP address. If your browser sends a Global Privacy Control signal, we automatically apply "Essential only."

2. How we use information

• To respond to your inquiry and run a conflict-of-interest check before discussing any matter.
• To set up, administer and bill an engagement with an attorney or law firm.
• To protect the Site and our business against fraud, spam, abuse and security incidents.
• To comply with law, professional obligations, court orders and litigation holds.

We do not sell personal information, share it for cross-context behavioral advertising, or use it for targeted advertising, and we have not done so in the past 12 months.

3. Who we share information with

We share information only with service providers that process it on our behalf under contractual confidentiality and data-protection obligations:

We may also disclose information when required by law, subpoena or court order; to protect the rights, safety or property of Holistic Pathways or others; or to a successor in connection with a merger, sale or reorganization of the practice, subject to this policy.

4. Consumer health data privacy policy

Some state laws, including Washington's My Health My Data Act, Nevada SB 370 and the Connecticut Data Privacy Act, protect "consumer health data." A case summary you send us could reveal health information about you or someone else, so we treat it as consumer health data.

• What we collect: any health-related details you choose to include in a form submission or correspondence, such as the type of injury or treatment involved in a matter.
• Source: directly from you.
• Why: only to evaluate and respond to your inquiry, run a conflict check and set up an engagement you request.
• Who receives it: only the service providers listed in section 3, acting on our behalf. We never sell consumer health data and never use it for advertising.
• Your rights: you may confirm whether we hold your consumer health data, get a copy, request deletion, withdraw your consent and appeal a decision about your request. Email intake@holisticpathwaylegal.com with the subject "Health Data Request." We respond within 45 days and do not charge a fee.

Records exchanged during a confirmed engagement are governed by our engagement agreement, any Business Associate Agreement, court orders and applicable law, including HIPAA where it applies.

5. Your privacy rights

Depending on where you live, laws such as the California Consumer Privacy Act (as amended by the CPRA) and the privacy laws of Colorado, Connecticut, Virginia, Texas, Oregon and other states may give you the right to:

• know what personal information we hold about you and get a copy;
• correct inaccurate information;
• delete your information;
• opt out of sale, sharing or targeted advertising (we do none of these); and
• not be discriminated against for exercising your rights.

Whether or not a particular law applies to us, we honor these requests. Email intake@holisticpathwaylegal.com. We will verify your request by matching it to the email address you used, respond within 45 days, and tell you how to appeal if we deny any part of it. You may use an authorized agent with your signed permission. We treat browser opt-out signals such as Global Privacy Control as a valid opt-out request.

6. Calls, texts and WhatsApp

The WhatsApp button on the Site opens WhatsApp with a short message pre-written for you. Nothing is sent until you press send, and the message contains no personal or health information. WhatsApp is operated by Meta and is not a channel for medical records, so please do not share patient details there. If you check the consent box on our form, we may contact you about that inquiry by email, phone, text message or WhatsApp. We will not send you marketing text messages without separate written consent. Reply STOP to any text message to opt out. Message and data rates may apply. Consent is not a condition of hiring us.

7. Retention and security

Inquiries that do not lead to an engagement are deleted within 12 months of our last communication, unless we need to keep them for a conflict check, a legal obligation or a dispute. Engagement records are kept for the period in the engagement agreement or as required by law or litigation hold, and then securely destroyed.

We use reasonable administrative, technical and physical safeguards, including HTTPS encryption across the Site, multi-factor authentication and restricted access to stored inquiries. No method of transmission or storage is completely secure. If a breach affects your personal information, we will notify you as required by applicable law, including Michigan's Identity Theft Protection Act.

8. Children

This Site is intended for attorneys and legal professionals. It is not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we will delete it.

9. Changes to this policy

We will post any changes on this page and update the date above. If we make a material change to how we use consumer health data, we will ask for your consent where the law requires it.
